Terms and Conditions of Online Trade for 'IT Engine' Trading as 'IT Hub'
Introduction
These Terms and Conditions ("Agreement") govern your (the Customer, "you") use of the IT Hub website ("ithub.nz") and your purchases from IT Hub ("we," "us," or "our"). By accessing our website or making a purchase, you agree to be bound by these Terms and Conditions. Please read them carefully. These terms and conditions apply exclusively to goods and/or services purchased through the Website. Purchases made from IT Engine through other channels may be subject to different terms and conditions.
Terms of Payment
All customers are required to prepay for orders unless credit terms have been approved by IT Hub. In the case that credit has been granted, separate payment terms will apply.
Title of Goods
Ownership and title of the goods purchased from IT Hub pass to you upon full payment of the purchase price. Until full payment is received, IT Hub retains the right to reclaim and repossess any goods sold.
Errors and Omissions Disclaimer
While we strive to provide accurate, up-to-date information, including product descriptions, prices, and availability, errors and omissions may occur. IT Hub does not guarantee the accuracy, completeness, or reliability of any information provided on the Website. We reserve the right to correct errors and update information without prior notice.
Shipping
Shipping costs are calculated at the time of purchase. For large orders or heavy items, please contact IT Hub for an updated shipping cost. If shipping costs exceed the initial estimate due to the nature of your order, our representative will contact you to discuss alternative shipment methods.
International Orders
At this time, we only accept orders within New Zealand.
Drop Shipping
IT Hub utilise drop shipping for some products, directly processing orders from vendors to customers. Please note that product tracking information may not always be immediately available.
Order Pick Up
IT Hub is an online store only and does not offer local pick-up options.
Delivery Times
Delivery times are provided as estimates and may vary due to the nature of drop shipping. IT Hub cannot guarantee delivery times.
Return Policy
If you are not fully satisfied with your purchase, you can return it within 7 days of purchase, subject to the following conditions:
- The product must be in original, unopened condition with all packaging, accessories, and documentation intact.
- You must obtain approval from IT Hub before initiating a return.
- Return shipping costs are your responsibility, except when the return is due to an error on our part or a defective product.
- Refunds will be issued via the original payment method or through a direct transfer.
Restocking Fee
A 20% restocking fee will apply to all returned products, except when the return is due to an error on our part or defective products.
Non-Return of Opened Software
Software that has been opened cannot be returned unless defective. Compatibility issues are the responsibility of the customer.
Limitation of Liability
IT Hub is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or performance of the products or the Website, including but not limited to data loss, loss of profits, or business interruptions.
Governing Law and Jurisdiction
These terms and conditions are governed by the laws of New Zealand, and any disputes will be resolved under New Zealand's jurisdiction.

Consumer Guarantees Act

Pricing and Payment
Prices are exclusive of installation, maintenance, GST, freight, and any applicable taxes unless otherwise stated. We reserve the right to revise prices prior to order acceptance. Payment is due upon acceptance of your order unless credit terms have been approved.
Delivery
IT Hub will deliver goods to the specified location or arrange for transportation. All transportation costs will be borne by the customer, unless otherwise agreed.
Returns and Cancellations
Products may be returned within 7 days of purchase under certain conditions, such as incorrect items being delivered or defective goods. Special orders and opened software cannot be returned unless defective.
Risk and Ownership
Risk of loss or damage to the goods passes to you upon delivery. Ownership remains with IT Hub until payment is made in full. If you resell goods before ownership transfers, the proceeds must be held in trust for IT Hub.
Guarantees and Warranty
Where applicable, the Consumer Guarantees Act provides rights regarding product guarantees and warranties. IT Hub may repair, replace, or refund faulty products in accordance with the Act.
Default and Collection
If payment is not made by the due date, a default penalty of 2.5% per month will apply. You will be responsible for any collection fees, including legal costs, incurred in recovering overdue amounts.
Privacy and Information Use
By purchasing from IT Hub, you consent to the collection, use, and storage of your personal information in accordance with our Privacy Policy. You also agree to receive marketing communications from IT Hub.
Limitation of Liability
IT Hub’s total liability for any claims related to this Agreement is limited to the price of the goods or services supplied.

These Terms and Conditions supersede any prior agreements, representations, or warranties, and any waiver of rights must be specified in writing by an authorised representative.
Sale of Restricted Goods
The sale of restricted goods is subject to specific laws. By placing an order for such goods, you warrant that you meet the minimum age requirement and are eligible to purchase, use, or view the restricted goods.

Free freight offers apply only to standard-sized items under 20kg for retail customers, with a minimum spend of $20. Exclusions include rural, express, Saturday, and international shipping.
